Assessment according to the Machinery Directive

Law requires risk assessment
The regulations of the European Machinery Directive have to be transposed into national law by each member state. In Germany, this has been implemented in the form of the ninth Ordinance to the Product Safety Act (ProdSV) – in short: ninth ProdSV. This Machinery Ordinance does not explicitly require a risk assessment, but rather a conformity assessment procedure. However, the identification and estimation of the risks associated with a machine represent the basis of such a conformity assessment and is therefore the prerequisite for the CE marking. The preparation of a assessment is therefore required by law. It is not a voluntary service of the manufacturer. Furthermore, it serves as an indispensable basis for liability-proof documentation.
